Florida Child Neglect Laws
According to Florida law, child neglect occurs when a parent or other person legally responsible for caring for a child fails to provide for the child’s basic safety or health or knowingly exposes the child to a material danger. If child neglect does not result in physical injury to the child, then it is a third-degree felony, but the penalties are more severe if children suffer injury because of the defendant’s neglect.

Children learn in elementary school how to respond in various emergencies, and a 12-year-old boy in South Florida applied those lessons with aplomb toward the end of last school year, perhaps saving his own life and that of his younger sister in the process. In May 2026, a woman was driving on Connector Road in Miami-Dade County, just west of I-95. She lost control of the car, resulting in a single-vehicle collision. Her 12-year-old son immediately got out of the car and took his two-year-old sister out of her car seat. Standing on the curb beside the road, holding the baby, the boy flagged down a police officer. By the time the police car stopped, the crashed car had caught fire, and the officer helped the driver get out safely.
The officer noticed that the driver seemed impaired. In a dashcam recording, the driver’s preteen son can be heard saying that she is drunk. The officer administered a breath test, and the driver’s blood alcohol content (BAC) was 0.21 percent, which is more than two-and-a-half times the legal limit of 0.08 percent. Police arrested the driver and booked her into the Miami-Dade County jail. She was charged with two counts each of DUI, DUI with damage to property, and child neglect with no great bodily harm. News reports did not publish any additional information about the outcome of the defendant’s criminal case or about any family law cases involving her children.

Everyone in Florida knows to avoid going outside during the hottest parts of the day in the summer. In September 2026, Miami Gardens police responded to a call from a witness about a baby left unattended inside a car in the parking lot of a two-story mall. The mother had driven to the mall and left the one-year-old child inside the car while she went inside to get her hair styled at a hair salon. Police arrived and immediately removed the baby from the car; the police report noted that she was in good health, despite having been alone in the car for about an hour. They contacted the child’s father, who arrived quickly at the mall parking lot and took the child home. The mother is facing criminal charges for felony child neglect.
